1. General
a) The GearSkinz™ website (the "Website") is an interactive on-line service which offers retail services provided by GearSkinz™
Limited.
b) Please read these Terms and Conditions very carefully. By using the Website (other than to read these Terms and Conditions for
the first time), you are agreeing to accept, without modification, and comply with, all of the Terms and Conditions below.
c) These Terms & Conditions do not affect your statutory rights as a consumer.
d) This site is operated by GearSkinz™ Ltd, a company registered in England & Wales; Company Registration No. 06618277;
Registered Office: Seymour Chambers, 92 London Road, Liverpool L3 5NW.
2. Description of goods
a) We take great care to describe our products correctly and the description and price of the goods you order will be as shown on
our website at the time you place your order.
b) All goods are subject to availability. If on receipt of your order the goods you have ordered are not available, we will inform
you as soon as possible and refund or re-credit you for any sum that has been paid by you.
c) Every effort is made to ensure that prices shown on the website are accurate at the time you place your order. If an error is found,
we will advise you as soon as possible and offer you the option of re-ordering at the correct price, or cancelling your order. If we do not receive
re-order confirmation within 14 days of advising you of the error, the order will be cancelled automatically. If you cancel the order, or if the order
is cancelled automatically due to the expiry of the 14 day period, we will refund or re-credit you for any sum that has been paid by you for the goods.
d) In addition to the price, you will be required to pay a delivery charge for the goods: please see Clause 4 below – Delivery &
Despatch.
3. Orders & Payment
a) Orders and payment in full must be placed via our on-line ordering system
b) Following your order, you will receive an email confirming that your order has been received and is being processed.
c) Payments will include VAT at the current applicable rate
d) You should always check that the contact information you provide is correct before creating a customer account or proceeding to
payment.
e) You are responsible for maintaining your own username and password, where required to access your customer account. You should
ensure that you store your username and password securely and that the details required to access your customer account are not provided to another
party.
f ) As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your
customer account username and password or other details have become known to a third party, you should inform us immediately.
4. Delivery & Despatch
a) GearSkinz™ uses a reputable courier for delivery and will make every effort to ensure your goods are delivered as quickly
and reliably as possible.
b) We will aim to despatch all online orders within 10-15 working days of receipt of your order and we will advise you as soon as
possible if there are likely to be any delays.
c) If you have not received your goods with 5 working days of the despatch period then please notify us immediately.
d) If you are not available to take receipt of your order, our couriers will attempt to redeliver the following working day. If we
are still unable to deliver, the order will be returned to us and you will be asked to contact us to arrange a delivery date and an additional fee
will be charged for redelivery.
e) Upon receipt of the order, you will be asked to sign for the goods received in good condition. If the package does not appear to
be in good condition, please refuse the delivery. If you are unable to check the delivery on receipt, please sign for the delivery as unchecked. Failure
to do so could affect any subsequent warranty claims you may make.
f ) If the goods supplied to you are damaged on delivery, you should notify us in writing via e-mail to help@gearskinz.co.uk within 14 days.
5. Warranty
a) All goods supplied by GearSkinz™ are warranted free from defects for 12 months from the date of supply (unless otherwise
stated). This warranty does not affect your statutory rights as a consumer.
b) This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by
you or any third party, use otherwise than as recommended by GearSkinz™, failure to follow GearSkinz™’ instructions, or any alteration
or repair carried out without our approval.
c) If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should
notify us in writing via e-mail, as soon as possible, but in any event within 14 days of the date you discovered or ought to have discovered the damage,
defect or complaint.
6. Returns Procedure
a) We take care to ensure that the products you receive are to your specification, however, should you wish to return your order for
any reason other than damage, please contact us within 7 days of receipt.
b) All returns must first be authorised by GearSkinz™. Authorisation can be received by emailing your reason for return to
help@gearskinz.co.uk.
c) You will be responsible for organising the return shipping and any associated costs. If requested, we can arrange for collection
of goods for return given authorisation for such return - you will be advised of the cost for this service prior to collection. Please do not return
goods without the proper authorisation as you may not receive a refund or replacement.
d) For custom orders where the measurements have not been supplied by GearSkinz™ (i.e. measurements provided by the customer)
returns will not be accepted unless the goods are faulty or damaged (see Clause 4 above). Refunds for customer mis-measurement may be considered
and will be solely at the discretion of GearSkinz™.
7. Privacy
a) GearSkinz™ is totally committed to respecting and protecting your privacy and will never pass the information you provide
to any third parties.
b) We will retain customer information to improve your shopping experience and to keep you informed of special offers, new products
etc., unless you wish to unsubscribe.
8. Security
a) At GearSkinz™ we take security very seriously. All on-line transactions are made through well-known secure services, however
GearSkinz™ are not liable for any losses incurred by customers making credit card payments through the internet.
b) Customers are solely liable for the personal and financial details they enter into their computer when ordering from GearSkinz
™ and GearSkinz™ are excluded from all liability or losses sustained as a result of information being compromised.
9. Complaints
a) In the event of a serious complaint regarding our products or service, please email us at help@gearskinz.co.uk or write to our Registered Office at the following address: GearSkinz™ Ltd, Seymour Chambers, 92 London Road, Liverpool L3 5NW.
b) All complaints will be investigated and explanations provided where possible to the satisfaction of all parties.
10. Force Majeure
a) In the event that GearSkinz™ is prevented from carrying out our obligations under a contract for sale as a result of any
cause beyond our control such as but not limited to Acts of God, War, Acts of Terrorism, Industrial Disputes, Lock-outs, Flood and Failure of third
parties to deliver goods, GearSkinz™ shall be relieved of its obligations and liabilities under such contract for sale for as long as such fulfillment
is prevented.
b) GearSkinz™ is not liable for any consequential loss arising from such an event.
11. Intellectual Property, Trade & Copyright
a) GearSkinz™ is a Registered Trademark and is protected by copyright and Intellectual Property Rights.
b) The full range of GearSkinz® Cases and GearSkinz Detachable Strap Systems® are Registered Designs.
